1. Acceptance of These Terms
These Terms of Service (“Terms”) form a binding agreement between you (“you,” “User”) and TrueCode Technologies Inc governing your access to and use of the TrueInterview website, applications, and related services (collectively, the “Service”).
By accessing or using the Service, creating an account, or submitting any content, you agree to be bound by these Terms and by our Privacy Policy, DMCA Policy, and Content Submission Guidelines, each incorporated by reference. If you do not agree, do not use the Service.
If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms. If you do not have such authority, you may not use the Service on behalf of an organization.
You acknowledge that clicking “Create Account,” uploading personal resume data, triggering resume generation, or enabling auto-submit functions constitutes your explicit electronic acceptance of all liability-waiver, indemnity, and limitation-of-damages clauses set forth below, which are material contractual terms.
2. Eligibility
You must be at least 16 years of age (or the age of digital consent in your jurisdiction, if higher) to use the Service. By using the Service you represent that you meet this requirement and that you are not barred from receiving services under the laws of any applicable jurisdiction.
You further warrant that you hold full legal authority to disclose all personal, employment, credential, and background information contained in your resume and application materials; you shall not upload government IDs, tax records, social security numbers, medical records, or other highly sensitive regulated personal data.
3. Description of the Service; Nature of the Platform
TrueInterview is an interview-practice and preparation platform. Content on the Service is contributed by Users and consists of original recollections, write-ups, and practice material relating to interviews and technical problems.
You acknowledge and agree that:
- TrueCode Technologies Inc acts as a service provider as defined under 17 U.S.C. § 512(k)(1) and a passive conduit for User-generated content. We do not exercise editorial control over User Content. We passively receive and store content uploaded by Users and do not pre-screen, endorse, or verify it except as required by law or our internal policies. The Service offers practice and simulation material only. We do not claim to provide, and do not provide, any company’s actual, confidential, or proprietary interview questions.
- TrueCode Technologies Inc does not verify the truthfulness, accuracy, legality, or compliance of any resume, application response, or auto-submitted material created or sent via our platform. We do not confirm employer hiring rules, Equal Employment Opportunity (EEO) compliance, or third-party ATS system formatting requirements. Automated submission functions transmit user-provided data to third-party job boards and employer portals solely at your explicit instruction; we have no control over third-party employer platforms, their privacy policies, hiring standards, or data-retention rules.
- Any references on the Service to algorithmic concepts, problem types, or publicly known interview topics describe ideas and facts, which are not subject to copyright protection.
- DMCA safe-harbor eligibility. TrueCode Technologies Inc operates as a service provider eligible for the 17 U.S.C. § 512 safe-harbor categories: it maintains a repeat-infringer account-termination policy, does not exercise editorial control over user uploads, resume text, or AI output content beyond automated formatting required to deliver the Service, and designates a Copyright Agent to receive infringement notices as described in our DMCA Policy.
4. User Accounts
You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You agree to provide accurate registration information and to keep it current. Notify us immediately of any unauthorized use.
5. User-Generated Content
5.1 Ownership
You retain all ownership rights, including copyright, in the original content you submit to the Service (“User Content”). These Terms do not transfer ownership of your User Content to us.
5.2 License Grant
By submitting User Content, you grant TrueCode Technologies Inc a non-exclusive, worldwide, royalty-free, sublicensable, and transferable license to host, store, reproduce, display, distribute, modify (solely for formatting and presentation), create derivative displays of, and otherwise use your User Content for the purposes of operating, promoting, and improving the Service. This license continues for so long as your User Content remains on the Service and, thereafter, for a period of up to ninety (90) days for backup, archival, and legal-compliance purposes, and for such longer period as may be required by applicable law or legal-hold obligations.
Special license carveout for personal resume data. The license granted for resume, personal-identity, and job-application data is limited exclusively to delivering the Career Tools. TrueCode Technologies Inc shall not use de-identified or identified resume personal data for marketing or third-party advertising without your separate written opt-in consent. You grant us a limited sublicense to transmit your resume data to third-party LLM providers and job-board platforms solely to complete your requested resume-generation and auto-submit actions.
You further acknowledge that, as described in our Privacy Policy, your User Content may be transmitted to and processed by third-party large-language-model (“LLM”) providers in connection with delivering the Service.
5.3 User Representations and Warranties
For each piece of User Content you submit, you represent and warrant that:
- Originality. The content was authored by you in your own words and is your original work. It is not copied, in whole or in part, verbatim or near-verbatim, from any third party.
- No verbatim third-party material. You have not reproduced problem statements, solutions, diagrams, or other expression copied from third-party platforms (including but not limited to LeetCode, NowCoder, HackerRank, or any employer’s materials). Any reference to a known problem is restated entirely in your own language.
- No confidentiality breach. Your submission does not violate any non-disclosure agreement (“NDA”), confidentiality obligation, employment agreement, or duty you owe to any person or entity, and does not disclose any trade secret or non-public proprietary interview material of any company.
- No infringement. Your User Content does not infringe or misappropriate any copyright, trademark, trade secret, privacy, publicity, or other right of any third party.
- Authority. You have all rights necessary to grant the license in Section 5.2.
- No compensation. You have not received, and will not receive, any compensation or other consideration from any third party for the creation or submission of this content.
5.4 Compilation and Database Rights
The selection, coordination, arrangement, classification, and organizational structure of content on the Service are independently designed by TrueCode Technologies Inc and are protected as a compilation under U.S. copyright law and, where applicable, as a database under sui generis database rights. You may not copy, reproduce, scrape, or extract the structure, taxonomy, or arrangement of the Service or any substantial portion thereof.
Disclaimer. TrueCode Technologies Inc does not verify, endorse, or guarantee the accuracy, completeness, originality, or legality of any User Content. Users are solely responsible for their submissions. We do not assume any obligation to monitor User Content for compliance.
AI output addendum. The foregoing disclaimer fully extends to all AI-generated resume and application materials. TrueCode Technologies Inc bears no responsibility for factual inaccuracies, grammatical errors, misrepresentation, or copyright/trademark infringement contained within any AI output created at your request.
6. Prohibited Content and Conduct
You may not submit, post, or transmit content that:
- Is copied verbatim or near-verbatim from any third-party source;
- Reproduces copyrighted problem statements, solutions, figures, or text owned by others;
- Discloses any company’s confidential, non-public, or proprietary interview questions, or any material covered by an NDA or other confidentiality obligation;
- Is unlawful, defamatory, harassing, fraudulent, or invasive of another’s privacy;
- Contains malware or attempts to interfere with the Service’s operation;
- Misrepresents your identity or affiliation, or impersonates any person or company.
You also may not scrape, data-mine, reverse-engineer, or use automated means to access the Service except as expressly permitted. We may, in our sole discretion and without prior notice, remove content and suspend or terminate accounts that violate these Terms, including for repeat infringement.
7. Trademarks and Third-Party Names
Company names and trademarks that appear in User Content (for example, in a User’s description of where they interviewed) are used solely for descriptive and nominative purposes to identify the subject of the User’s experience. All company names, logos, and trademarks are the property of their respective owners and are used for identification and descriptive purposes only.
8. Copyright and DMCA
We respond to notices of alleged copyright infringement in accordance with the U.S. Digital Millennium Copyright Act (17 U.S.C. § 512). Our full takedown and counter-notice procedures, designated-agent information, and repeat-infringer policy are set out in our DMCA Policy, incorporated here by reference.
9. Indemnification
You agree to defend, indemnify, and hold harmless TrueCode Technologies Inc and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to: (a) your User Content; (b) your breach of any representation or warranty in Section 5.3; (c) your violation of these Terms; or (d) any third-party claim arising from or relating to your submission, including claims of copyright infringement, trade-secret misappropriation, or breach of confidentiality.
10. Disclaimer of Warranties
11. Limitation of Liability
To the maximum extent permitted by law, TrueCode Technologies Inc and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising from or related to your use of the Service or any User Content accessed through the Service. The foregoing limitations apply regardless of the legal theory under which any claim is brought, whether in contract, tort (including negligence), statute, or otherwise.
To the maximum extent permitted by law, our total aggregate liability for all claims relating to the Service will not exceed the greater of (a) the amount you paid us in the twelve months preceding the claim, or (b) USD $100. Some jurisdictions do not allow certain limitations; in such jurisdictions our liability is limited to the maximum extent permitted by law.
12. Termination
We may suspend or terminate your access to the Service at any time, with or without cause or notice. Upon termination, the licenses you granted in Section 5.2 survive to the extent described therein, and Sections 5.1, 9, 10, 11, and 13–15 survive.
Upon account termination for breach of Tools rules (e.g., fraudulent resume generation, mass spam applications, copyright infringement), TrueCode Technologies Inc shall delete stored resume personal data within 30 days, unless legal-hold obligations require retention.
13. Governing Law
These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-laws principles.
14. Dispute Resolution
Informal resolution first. Before filing any claim against TrueCode Technologies Inc, you agree to first contact us at kevin@trueinterview.io with a written description of the dispute and give us thirty (30) days to attempt to resolve it informally. Most concerns can be resolved this way.
Exclusive venue. Any legal action or proceeding arising out of or relating to these Terms or the Service that is not resolved informally shall be brought exclusively in the state or federal courts located in the State of Delaware. You and TrueCode Technologies Inc irrevocably consent to the personal jurisdiction and venue of those courts and waive any objection based on inconvenient forum.
Class-action waiver. To the maximum extent permitted by law, you and TrueCode Technologies Inc agree that any proceeding will be conducted only on an individual basis and not as a class, consolidated, or representative action. This waiver applies to all claims arising from the Service, including claims involving AI resume generation, automated submission, data privacy, or intellectual property. If this waiver is found unenforceable as to a particular claim, that claim (and only that claim) may proceed on a non-individual basis.
Time limit. To the extent permitted by law, any claim arising out of or relating to the Service must be filed within one (1) year after the claim accrued, or it is permanently barred.
15. Changes to These Terms
We may update these Terms from time to time. Material changes will be posted with an updated “Last Updated” date and, where required, communicated to you. Your continued use of the Service after changes take effect constitutes acceptance.
